Uppa Terms of Use
Effective: 31 October 2026
These terms are an agreement between you and Zero Morphism LLC, a California limited liability company, 647 Escuela Pl, Milpitas, CA 95035 ("Uppa", "we", "us"). They cover the Uppa app, website and emails (the "Service"). Please read them. Sections 2 and 3 matter most.
1. Who can use Uppa
- You must be 18 or over.
- At launch, Uppa is available in the United States and the United Kingdom. If we make it available in the European Union or the European Economic Area (together, the "EU"), the lines for EU consumers in these terms apply there.
- You must give accurate information when you set up and log. The plan depends on it.
- One person per account. Keep your sign-in safe, and tell us at support@flyuppa.com if someone else gets in.
2. Uppa is not medical care
Uppa is not medical advice, diagnosis or treatment, and it is not for emergencies.
- It suggests everyday habits around your treatment, such as when to drink, eat or move. It is not a substitute for your doctor, nurse, pharmacist or dietitian.
- It never tells you to start, stop, change or time a medicine or a dose. Follow your prescriber.
- "Worth a call" and "what to expect" are general prompts, not a judgment about your health. If you're worried, contact your care team.
- In an emergency call 911 (US), 999 (UK) or 112 (EU). In the UK you can also call 111 for urgent advice.
- Talk to your clinician before changing what or how much you eat or drink if you have a medical condition, a fluid or salt restriction, diabetes, kidney disease, a history of an eating disorder, or are pregnant or breastfeeding.
- Nutrition from photos and descriptions is an estimate and can be wrong.
- The medicine level shown in the app is an estimate based on the label's half-life, for understanding your week. It is not a measurement and not a guide to dosing.
- The research cards summarise published studies about people on these medicines in general. They are not results from Uppa and don't promise what will happen to you.
3. Your health data
How we handle your data is set out in the Privacy Policy and the Consumer Health Data Privacy Policy. They are part of these terms. We ask separately for your consent to health data, and that consent isn't buried in these terms.
4. Beta testing and TestFlight
If we invite you to test Uppa before it launches, the Beta Tester Terms (sent with your invitation) also apply.
Test versions come through Apple's TestFlight and are beta software. They may have bugs, change often or be unavailable at times. Apple's TestFlight terms also apply.
5. Subscriptions
- Payment through Apple: paid features are sold through Apple's in-app purchase. Apple takes the payment.
- Before you buy, the app shows the price, the billing period and what's included.
- Renewal: a subscription renews automatically at the end of each period until you cancel. You can cancel at least 24 hours before renewal in your Apple ID settings (Settings → your name → Subscriptions). The app tells you how.
- 14-day free trial: new subscribers can try Uppa free for 14 days. Before you start, the app shows the date the trial ends and the price after it. Unless you cancel at least 24 hours before the trial ends, Apple charges the subscription price on that date and the subscription then renews automatically. If you cancel during the trial, you aren't charged. One free trial per person; Apple applies this per Apple ID.
- Refunds: handled by Apple under its policies, at reportaproblem.apple.com. UK and EU consumers keep their statutory rights to cancel, including the 14-day right of withdrawal where it applies. Apple handles these for in-app purchases.
- Price changes: we'll give notice of any change before it applies. Where Apple or the law requires it, we'll ask you to agree to a price rise first.
6. Your licence to use Uppa
We give you a personal, non-transferable, revocable licence to use the app on Apple devices you own or control, for your own non-commercial use, under these terms and Apple's Licensed Application End User License Agreement. Apple isn't responsible for the app or its support; we are.
7. What you mustn't do
- Use Uppa for someone else, or for anyone under 18.
- Copy, resell, reverse engineer, scrape or overload the Service, except where the law lets you.
- Upload anything unlawful or harmful, or someone else's private information, or try to get into other accounts.
- Use Uppa's content (including the research cards) to make claims about Uppa's effects, or for commercial purposes.
8. Your content
You own what you log and write. You give us a licence to store and use it only to provide the Service to you, as the Privacy Policy describes. This includes de-identified improvement only if you switched on "Improve Uppa".
9. Feedback
If you send us ideas or suggestions, we may use them without owing you anything. We won't use your name, words or story publicly without asking first.
10. Our content
The app, its plan engine, text, cards, design and brand belong to us or our licensors. Research summaries cite their sources, which belong to their authors.
11. Other services
Uppa may link to other websites or work with Apple features. We're not responsible for their content or practices.
Apple Health: if you allow it, Uppa reads your wake and bed times and your weight from Apple Health. It reads only what you allow, never writes to Apple Health, and you can stop it at any time in the Health app or iPhone Settings.
12. Changes to Uppa and to these terms
- The Service: we may change, add or remove features. If we remove something you've paid for, we'll tell you and offer a fair remedy.
- These terms: if we change them in a way that matters, we'll tell you in the app or by email at least 14 days before the change applies. If you keep using Uppa after that, the new terms apply. If you don't agree, you can stop using it and delete your account.
- EU consumers: if we change the Service in a way that makes it more than slightly worse for you, we'll tell you in advance, and you can end your subscription free of charge within 30 days of the change. We'll make sure you're refunded for any part you've paid for and can no longer use.
13. Ending
You can stop at any time and delete your account in Profile → Privacy. We may suspend or close an account that breaks these terms or the law, or if we stop offering Uppa. If we do, we'll give notice where we reasonably can, and you can export your data first.
14. Disclaimers
We work hard to make Uppa accurate and available. But to the extent the law allows, the Service is provided "as is" and "as available", without warranties of fitness for a particular purpose, accuracy or uninterrupted use.
UK and EU consumers: nothing in these terms affects your statutory rights.
- UK: digital content must be of satisfactory quality, fit for purpose and as described.
- EU: you have a legal guarantee that the Service matches these terms and what we've told you about it. If it doesn't, you can ask us to fix it. If we can't, or don't within a reasonable time, you can ask for a price reduction or end the contract.
15. Our liability
Nothing in these terms limits liability that the law doesn't allow us to limit. That includes death or personal injury caused by negligence, fraud, and (for UK and EU consumers) breach of your statutory rights.
UK and EU consumers: we're responsible for loss you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care. The limits below apply only as far as the law where you live allows. They never limit our liability for intentional wrongdoing or gross negligence.
Otherwise, to the extent the law allows:
- we aren't liable for indirect or consequential loss, or for losses caused by following a suggestion against your clinician's advice;
- our total liability to you is limited to the greater of the amount you paid us in the 12 months before the claim and US$100 (£100 in the UK, €100 in the EU).
16. Indemnity (US users only)
If you're in the US and you break these terms or the law, and that causes a claim against us, you'll cover our reasonable costs of that claim. This doesn't apply to UK or EU consumers.
17. Law and disputes
- US users: the laws of the State of California apply, without regard to conflict-of-law rules. Disputes go to the state or federal courts in Santa Clara County, California, unless the law says otherwise.
- UK users: the law of the part of the UK where you live applies, and you can bring claims in your local courts. You keep the protection of the mandatory consumer laws there.
- EU users: the laws of California apply, but you keep the protection of the mandatory consumer laws of the country where you live, and you can bring claims in the courts of that country. We can bring claims against you only in those courts.
- Before going to court, please email support@flyuppa.com so we can try to sort it out.
18. General
- If part of these terms can't be enforced, the rest still applies.
- If we don't enforce a right straight away, we haven't given it up.
- You can't transfer these terms. We may transfer them to a buyer of Uppa, who must keep them.
- These terms, the policies they mention and, for testers, the Beta Tester Terms are the whole agreement.
